Zoning Appeals

Description:

The County Board of Zoning Appeals (BZA) is composed of five (5) members who are appointed by the Board of County Commissioners and who shall be residents of the unincorporated territory of the County.  The terms of all members shall be five (5) years and so arranged that the term of one (1) member will expire each year.  The BZA serves Madison County hearing cases related to appeals, variance, nonconforming uses, compatible nonconforming uses and conditional uses as outlined in the Madison County Zoning Code.

Purpose:

Hear and decide appeals where it is alleged there is error in any order, requirement, decision, or determination made by an administrative official in the enforcement of Section 303.02 to 303.25 of the Revised Code, or of any resolution adopted pursuant thereto.

Authorize upon appeal, in specific cases, such variances from the terms of the zoning resolution as will not be contrary to the public interest, where, owing to special conditions, a literal enforcement of the resolution will result in unnecessary hardship, and so that the spirit of the resolution shall be observed and substantial justice done. The Appeals Board shall state if all of the conditions are complied with when granting a requested variance.

A variance is not granted to the applicant ordinarily denied to other persons in the same zone district.
The reason for the variance request is not the result of any action, undertaken after the adoption of this Zoning Resolution, of any applicant that creates the need for the variance request.

The variance is related to the physical properties of the land, such as topography, lot shape, soil types, and conditions, natural and/or man-made drainage courses, and that these conditions do not generally apply to other areas within the same zoning district.

That the variance is not of the type generally requested, not recurrent that an amendment to this Zoning Resolution should be submitted rather than the granting of a variance.

Grant conditional zoning certificates for the use of land, buildings, or other structures if such certificates are provided for in the Zoning Resolution.

Revoke an authorized variance of conditional zoning certificate granted for the extraction of minerals, if any condition of the variance or certificate is violated.
